Terms of Service

Domains:

We register all domain names in the name provided by a customer at the time of sign up.

Albatross Hosting will accept all new registrations onto our system and register them as soon as possible after payment has been processed. However until either the domain becomes active on our system and/or the domain is registered via a WHOIS search we do not guarantee a domain has been secured for a customer.

The domain name registration period runs for 1 year from the date of registration. After this time period has lapsed registration renewal may be made upon receipt of payment of renewal fees. Some domains have a minimum registration of 2 years or 10 years so please double check with our full pricelist (found in the shop page) before ordering.

Once a registration request has been initiated or completed no refunds can be made. Until the registrant receives confirmation of registration from Albatross Hosting there is no guarantee that the domain name requested will be registered.

The registrant agrees that all details submitted in respect of a domain name registration are true and correct. The registrant makes certain to Albatross Hosting that the registration of a domain name and the way in which it is used (directly or indirectly) does not infringe the legal rights of any third party. Albatross Hosting do not accept any responsibility for the use of registered domain names especially where there may be conflict over rights to ownership. The registrant indemnifies Albatross Hosting from any legal proceedings and costs that arise as a result of the registration of a domain name.

Hosting Account Setup:

We will setup your account after we have received payment unless agreed otherwise, and we and/or our payment gateway have screened the order(s) in case of fraud. Should we need to contact you, the primary email address on file will be used for this purpose so preferably use an ISP email or a hotmail, gmail, yahoo or other account. It is your responsibility to ensure the email address on file is current or up to date at all times, so please inform us of any changes.

Transfers:

Our transfers team will make every effort to help you move your site to us, this does not carry any fees. Transfering a domain to another registrar carries a fee however cancelling a hosting account does not if the account is coming up for renewal. If it isn't then it carries a charge of Lm10.

 

Content:

All services provided by Albatross Hosting may only be used for lawful purposes as stipuated by the Laws of Malta (European Union). The customer agrees to indemnify Albatross Hosting from any claims resulting from the use of our services and website.

Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account.

We also prohibit content of pornographic, racist or inciting nature on our hosting accounts and any infringment will result in the termination of your account without refund, so if you have any doubts regarding the legality of your project please contact us prior to upload.

Failure to respond to email from our abuse department within 3 days may result in the suspension or termination of your services. We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, deceiptful or threatening is prohibited and will be removed from our servers with or without notice depending on the degree of infringement.

Any site found to host child pornography or linking to child pornography will be suspended immediately without notice. Such violations will also be reported to the relevant authorities.

 

Spam Policy:

We take a zero tolerance stance against sending of unsolicited e-mail and spam.

What is SPAM?

Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated. Albatross Hosting reserves the right to require changes or to make any such modifications in an emergency at its sole discretion. (We will however make an effort to contact you before taking any action required)

Albatross Hosting reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is entirely at the discretion of Albatross Hosting.

Unsubscribing from our services:

Cancellation of services must be done by replying to the account renewal reminder email and then in writing. Once we receive your cancellation and have confirmed all necessary information with you via e-mail, we will inform you that your account has been cancelled.

Albatross Hosting provides a 10 day grace period from the time the invoice is due and when it must be paid. Any invoice that is overdue for 10 days and not paid may result in a small late fee and/or an account suspension until account balance has been paid in full.

Backups and Data Loss:

Albatross Hosting is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Albatross Hosting servers.

PHP require/include:

When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include("http://yourdomain.com/include.php") use include("include.php")

Bandwidth Usage:

You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation (month), suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package. Unused transfer in one month cannot be carried over to the next month.
